Welcome to SafeFax. By using safefax.net ("the Service") you agree to these Terms of Service ("Terms"). Please read them carefully. If you don't agree, please don't use the Service.
1. Who we are
SafeFax is an online fax service. You can send and receive faxes from any computer, tablet, or phone without a fax machine. The Service is operated by SafeFax.
2. Your account
- You must be at least 18 years old to use the Service.
- You're responsible for keeping your account credentials and any assigned fax number secure.
- You're responsible for everything sent or received using your account.
3. Pricing & billing
You will be charged $4.95 today, plus applicable taxes, for your 7-day trial. After your introductory period, we will begin billing you $29.99 per month, plus applicable taxes, on a recurring basis until you cancel.
Optional upsells (Privacy+, Document Vault) are offered after checkout as separate one-time charges to your card — they are not added to your trial payment.
- All amounts are in U.S. Dollars.
- You authorize us (and our payment processor) to charge your payment method automatically for each renewal.
- You can cancel anytime from safefax.net/cancel or by emailing help@safefax.net. Cancellation stops future charges. Previous charges aren't refunded except where required by law.
- We may change pricing with at least 30 days' notice by email. If you don't agree, cancel before the new pricing takes effect.
4. Acceptable use
You agree NOT to use SafeFax to:
- Send junk faxes, spam, or unsolicited advertising in violation of the U.S. TCPA, JFPA, or any similar law.
- Send threats, harassment, or illegal content.
- Send material that infringes someone else's intellectual property or privacy rights.
- Attempt to disrupt, reverse-engineer, or abuse the Service.
- Impersonate any person or organization.
We may suspend or terminate your account for violations of this section, with or without notice.
5. Your content
You keep all rights to the documents you upload and receive. You grant us a limited license to store, transmit, and display your documents solely to operate the Service for you. We will never use your fax content for advertising or to train AI models.
6. Delivery is "best effort"
Fax delivery depends on the recipient's equipment and the public telephone network, which are outside our control. We retry failed sends automatically, but we can't guarantee any fax will reach its destination at a specific time. SafeFax is not suitable for time-critical or life-safety communication.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEFAX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
9. Termination
You can cancel at any time. We may suspend or terminate your account if you violate these Terms or if continued service would be unlawful.
10. Changes to these Terms
If we make a material change to these Terms, we'll notify you by email and update the "Effective" date at the top of this page. Continued use of the Service after that date means you accept the new Terms.
11. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Delaware.
